These Terms and Conditions ("Terms") govern your use of the Black & White Academy Ltd website and your enrolment on any course, programme, or service offered by us. Please read them carefully before booking or enrolling.

By accessing our website, making a booking, or enrolling on a course, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Black & White Academy Ltd is a company registered in England and Wales under Company Number 15762031. Our registered address is available upon request. References to "we", "us", or "the Academy" mean Black & White Academy Ltd.

All courses offered by Black & White Academy Ltd are subject to availability. We reserve the right to withdraw, amend, or reschedule any course at any time. Where a course is withdrawn after payment has been made, a full refund will be issued.

Enrolment is confirmed only upon receipt of a completed booking form and the required deposit or full payment. A confirmation email will be sent to the address provided at the time of booking.

We reserve the right to refuse enrolment to any individual at our sole discretion, including where we reasonably believe the individual does not meet the entry requirements or where their participation may be disruptive to other students.

Course content, duration, and delivery methods are described on our website and in course materials. We reserve the right to make reasonable amendments to course content where necessary to maintain quality or comply with awarding body requirements.

Students are expected to attend all scheduled sessions. Persistent non-attendance may result in withdrawal from the course without refund. Attendance requirements for accredited courses are set by the relevant awarding body and are non-negotiable.

Bookings for consultations, assessments, and appointments can be made via our online booking system, by telephone, or by email. All bookings are subject to availability and are confirmed only upon receipt of written confirmation from us.

We operate Monday to Thursday, 09:30–16:30. Bookings outside these hours will not be processed until the next available working day.

You are responsible for ensuring that the information provided at the time of booking is accurate and complete. We accept no liability for errors arising from incorrect information supplied by you.

We reserve the right to cancel or reschedule any appointment where circumstances beyond our reasonable control prevent us from honouring the booking. In such cases, we will provide as much notice as possible and offer an alternative date or a full refund.

All course fees are displayed on our website inclusive of VAT where applicable. Fees are subject to change without notice; however, any change will not affect a booking that has already been confirmed.

A non-refundable deposit is required to secure your place on a course. The deposit amount will be stated at the time of booking. The remaining balance must be paid in full no later than 14 days before the course start date unless a payment plan has been agreed in writing.

Payment plans are available at our discretion. Where a payment plan is agreed, all instalments must be paid on the dates specified. Failure to maintain payments may result in suspension from the course and the outstanding balance becoming immediately due.

We accept payment by bank transfer, debit card, and credit card via our secure payment processor. We do not store card details. All online payments are processed securely via Stripe.

NVQ funding and other government-backed funding may be available for eligible students. Eligibility is determined by the relevant funding body and is not guaranteed. We will assist with applications where possible but accept no liability if funding is refused.

All course fees paid to Black & White Academy Ltd are strictly non-refundable. By enrolling on a course and making payment, you acknowledge and agree that no refund will be issued under any circumstances, including but not limited to change of mind, personal circumstances, illness, or failure to attend.

If you wish to cancel your enrolment, you must notify us in writing by email to info@blackandwhiteacademyltd.com. Cancellation does not entitle you to a refund of any fees paid.

Where a student withdraws from a course after it has commenced, no refund will be issued for any sessions already delivered or remaining on the course.

If we cancel a course, you will be entitled to a full refund of all fees paid. We will not be liable for any additional costs incurred by you as a result of the cancellation, including travel or accommodation costs.

Refunds issued by us (in the event of Academy-initiated cancellation only) will be processed within 14 working days and returned to the original payment method.

All content on the Black & White Academy Ltd website, including but not limited to text, images, videos, course materials, logos, and branding, is the intellectual property of Black & White Academy Ltd or its licensors and is protected by UK and international copyright law.

Course materials provided to students are licensed for personal, non-commercial use only. You may not reproduce, distribute, publish, transmit, modify, or create derivative works from any course materials without our prior written consent.

You may not record, photograph, or otherwise capture any part of a course session without the express written permission of Black & White Academy Ltd and the consent of all other participants.

Any feedback, suggestions, or ideas submitted to us become the property of Black & White Academy Ltd and may be used without restriction or compensation to you.

The Black & White Academy Ltd name, logo, and associated marks are registered trademarks. Unauthorised use of our trademarks is strictly prohibited.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

Subject to the above, our total liability to you in connection with any course, booking, or use of our website shall not exceed the total fees paid by you to us in the 12 months preceding the event giving rise to the claim.

We are not liable for any indirect, consequential, or special loss, including loss of earnings, loss of opportunity, or loss of data, even if we have been advised of the possibility of such loss.

We make every effort to ensure that course content is accurate and up to date. However, we do not warrant that course materials are free from errors or omissions. Course content is provided for educational purposes only and does not constitute professional advice.

We are not responsible for the actions, conduct, or performance of any third-party awarding body, funding body, or external provider whose services are referenced on our website or used in connection with our courses.

All students are expected to conduct themselves in a respectful, professional, and courteous manner at all times. Behaviour that is disruptive, abusive, discriminatory, or threatening towards staff, other students, or third parties will not be tolerated.

We operate a zero-tolerance policy towards harassment, bullying, and discrimination of any kind. Any student found to be in breach of this policy may be immediately excluded from the course without refund.

Students are responsible for their own tools, equipment, and personal belongings. We accept no liability for loss or damage to personal property on our premises or during course activities.

Students must comply with all health and safety requirements communicated to them before and during the course. Failure to do so may result in exclusion from the session.

We process your personal data in accordance with our Privacy Policy and the UK General Data Protection Regulation (UK GDPR). By enrolling on a course or using our website, you acknowledge that we may collect and process your personal data as described in our Privacy Policy.

We will not sell, rent, or share your personal data with third parties for marketing purposes without your explicit consent.

These Terms constitute the entire agreement between you and Black & White Academy Ltd in relation to your use of our website and enrolment on our courses, and supersede all prior agreements and understandings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

We reserve the right to amend these Terms at any time. The current version will always be published on our website. Continued use of our services after any amendment constitutes acceptance of the updated Terms.

These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
